What types of property damage/interference does Section 430 of the Criminal Code classify as mischief?
In mischief cases, the accused is alleged to have damaged or otherwise unlawfully interfered with property they don’t solely own.
Keyed cars, slashed tires, graffiti, broken doors, windows, mirrors and phones are common examples of mischief where property is physically damaged. Road rage and parking lot cases are common in Halton Region. Mischief charges can also be laid without physical property damage in cases where bad behaviour alone is alleged to constitute property interference.
Domestic mischief cases involving matrimonial property broken in anger are also common in Ontario if reported to the police. The accused not only faces jail and a criminal record, they are also placed on no-contact release conditions requiring them not speak to their spouse/partner, which is often unwanted by both parties.
The police sometimes use mischief to criminally charge people for behaviour they don’t approve of, but is otherwise legal.
Halton Police (HRPS) may lay mischief charges for loud music, taking unwanted pictures, screaming and yelling, blocking people’s movements, and other forms of bad behaviour. They reason that bad behaviour itself is enough to criminally interfere with the use and enjoyment of the property, even if nothing is physically damaged.Getting charges dropped: The police don’t get to decide what constitutes criminal mischief.
What constitutes mischief is a decision for the judge in court after hearing all of the evidence, not the police. Meritless charges can be dropped without a trial if your lawyer can convince the Crown Attorney to withdraw during the initial pretrial stages.
Even if the Crown Attorney has a good case against you, sometimes the charges can be dropped or otherwise resolved without a trial or a criminal record. Your lawyer’s job is to try to convince the Crown it is not in the public interest to prosecute you. Upfront remedial measures like restitution and/or anger management may be offered by the defence to help persuade them to withdraw the charges.

If there is no reasonable prospect of conviction (RPC), the Crown is bound to drop the charges against you. Problems with the Crown’s case that can work in your favour include:- A lack of proof the accused caused the damage. Often a “logical suspect” is charged without an eye witness, confession, video, or any non-circumstantial evidence.
- The acts or behaviour alleged to be mischief by the police do not meet the legal definition of mischief as per Section 430 of the Criminal Code. We use actual Ontario court case precedents to compare facts and prove your innocence using prior case law.
- Bad or unreliable police evidence. Problems in the disclosure include inconsistent witness statements, police misconduct, logical fallacies, improper suspect identification, and Charter violations.
Those charged with or investigated for mischief offences should exercise their right to remain silent and not speak to the police. The police will lie to suspects about having evidence they do not have to extract confessions in cases they otherwise would not be able to prove.
