Those charged with drug offences in Toronto will usually receive an Undertaking or Release Order with a court date at 10 Armoury St, Toronto. Charges for drug possession, trafficking, and production are laid under the Controlled Drugs and Substances Act (CDSA), which is a criminal statute.

All CDSA defendants should immediately hire their own private lawyer because defence opportunities, such as deals to get the charges dropped, are often time sensitive in drug cases. Police informants and co-accused parties may already be trying to work out a deal behind your back (to your detriment). Sometimes it’s the little things that come back to bite the police in drug cases. Like the CCTV footage they didn’t know existed or the unethical officer remarks caught on bodycam. Project cases (large busts) can contain hours of audio and video recordings that may hold the key to your freedom. We use sophisticated techniques to review all of this evidence and find misconduct.

Our lawyers use data recovery, gps tracking logs, and metadata analysis to test the accuracy of the Crown’s disclosure. If there are inconsistencies, inaccuracies, or omissions found in the statements of the police, their informants, or any other Crown witnesses we will use them to your advantage.

Search warrants that rely on informant affidavits may contain untrue sworn statements or evidence of police corruption. These error-ridden copy/paste jobs are easily challenged in court. If the warrant is bad the evidence can be excluded via a Charter application that makes the Crown’s case fall apart.

This is one of the reasons most defendants should respectfully remain silent and not answer questions. Accused who talk to the police may end up incriminating themselves with their own words when the search warrant was bad to begin with. Had they remained silent and hired counsel right away they could have walked free.

Section 5 (2): Possession for the Purposes of Trafficking of Heroin, Cocaine, Fentanyl, Marijuana, and/or Methamphetamine

Section 7: Production of Heroin, Cocaine, Fentanyl, Marijuana, and/or Methamphetamine

Criminal Code or provincial offences may also be laid in addition to the CDSA drug charges. This includes firearms/weapons offences, possession of stolen property and provincial regulatory charges. Sometimes a deal is made to drop the CDSA and Criminal Code offences in exchange for a non-criminal provincial regulatory sanction.

Such deals are possible if problems are uncovered with the Crown’s case or if mitigating circumstances warrant it. Drug cases are often riddled with lies, corruption, Charter breaches, and other problems that our lawyers can use to get the charges dropped or reduced down.
