Oakville Theft Lawyer

We defend theft charges laid by Halton Regional Police.

Those charged with theft by Halton Regional Police will receive a court date at the 491 Steeles Ave E, Milton courthouse. A mandatory date for fingerprinting will also be assigned prior to court. Both the court date and fingerprint date will be stated on the Appearance Notice or Undertaking provided to the accused by the police (if not held for bail).

Everyone charged with theft (under or over $5000) in Ontario should hire a criminal defence lawyer immediately to represent them if possible. Ideally, your own private lawyer will be the first person to speak to the Crown Attorney about your case.

Some theft charges can be quickly dropped (withdrawn) depending on the circumstances and how the case is handled.

People get charged with theft in Oakville for similar reasons but not everyone gets the same case result.

Since Crowns use a lot of discretion to decide whether they prosecute or drop theft charges, hiring a defence lawyer to try to speak to the right Crown at the right time is very important. You don’t want a Crown who is tough on theft making decisions about your case if you can avoid them. Dealing with the right person can make the difference between the charges being dropped or not.

We know who to work with and who to avoid if possible.

If the right Crown is not available to talk to our lawyers don’t take any chances. We proactively seek decision makers who we are familiar with from our own previous theft cases that we think will be agreeable to drop your charges. If the right person isn’t available, we will try on another day instead. Our lawyers are very familiar with the Crowns who work at the Milton (Halton Region) courthouse.

Our lawyers work to get your fingerprints and other charge information destroyed in police databases like CPIC.

Not only do theft charges carry a potential maximum prison sentence of ten years, they can also show up on employment background checks, cause problems with IRCC immigration status, and prevent you from travelling to the United States.

Whether you are accused of shoplifting something from a store, stealing from your workplace, a vehicle related theft, or something else, in all cases your biometric data and charge information is being uploaded and shared in police databases like CPIC. If discovered by employers, professional regulators, IRCC, or US customs, it can be used as evidence to declare you to be a person of "bad character” and deny you.

We work to have your fingerprints and other theft charge information removed from police databases so they can't be used against you.

What if the Crown refuses to drop the charges?

Crowns may refuse to drop theft charges because of aggravating factors like breaches of trust, prior records, and the amount stolen being considered too high. Some of these cases will have to go to trial.

While the Crown may want you prosecuted, sometimes their evidence is lacking or contains problems that can help the defence. Our lawyers find these problems which may include exculpatory or unclear CCTV videos, Charter breaches, omissions of facts, and inconsistent witness statements. All defence options are on the table and we will do everything possible to make the Crown's case against you collapse at trial.
