Those charged with fraud in Oakville will usually receive an Undertaking or Appearance Notice from the police with a fingerprinting and court date at 491 Steeles Ave E, Milton. If held for bail, the accused may be released via a Release Order.

Anyone charged with fraud (under or over $5000) in Ontario should hire a lawyer to defend them immediately. Case outcomes can vary tremendously. The prosecuting Crown Attorney may assume you're guilty when you shouldn’t have even been charged to begin with.

Fraud charges are sometimes wrongly laid in circumstances that the police should deem to be civil disputes.

Complainants (alleged victims) sometimes file police reports to have fraud charges laid after a business or employment related disagreement. This allows the complainant to use the criminal justice system to recover their losses and avoid an expensive/risky lawsuit (to the detriment of the accused).

The criminal court can order the accused to pay full restitution to the alleged victim in addition to other punishments imposed. Sometimes the accused will reluctantly agree to pay restitution in exchange for the charges being dropped. No accused should feel pressured to pay or make a deal under these circumstances, but they may because the consequences of a fraud conviction are so severe.

If found guilty of fraud under s. 380 of the Criminal Code the accused is subject to a sentence of up to fourteen years in prison and a criminal record.

Since fraud is a crime of dishonesty, in addition to jail convicts face being deemed:
  1. Unemployable by the HR policies of most companies and government institutions;

  2. Of bad character and therefore not eligible for membership in regulated professions (nursing, engineering, etc);

  3. Inadmissible to the U.S. for committing an offence of moral turpitude.
Anyone accused of or being investigated for fraud should hire a lawyer right away and personally remain silent to avoid needlessly incriminating themselves.

You should not talk to the police, private investigators, or other third parties trying to gather evidence against you. Proving you have a guilty mind (mens rea) in court is much harder to do without any statements or admissions.

How we get fraud charges dropped: We use previous case precedents to prove you should not be held criminally liable.

If other accused people before you, who acted the same way as you allegedly did in comparable situations, were able to have their charges dropped (withdrawn) and avoid prosecution then you should too.

We use Ontario court case law and our own internal precedents to prove that your case should also be dropped. Sometimes we can show the Crown that other defendants walked free for the same allegation at the same courthouse.

You should remain silent if accused of fraud by an employer or business partner.

When confronted with a fraud allegation at work sometimes people say things they shouldn’t. In fear of losing their job, or hoping to resolve a business dispute, the accused may make incriminating admissions which are then reported to the police as evidence.

Even if you defrauded your employer there may not be enough evidence to convict you in court if tested at a trial. If you confess or make admissions against interest (thinking you were helping yourself) to investigators (police or private) you may give them what they need to have you charged or otherwise make things worse.

If the Crown refuses to drop the charges we will vigorously defend your case at trial.

The police may have taken the word of the complainant over yours for seemingly no reason other than they were the first to complain, but when tested in court their case may fall apart. We will conduct our own rigorous internal investigation to find the holes in the Crown’s case and present them at trial.
